Terms and Conditions:
- Booking and payment
- Please contact us to confirm availability for your chosen experience. To place a booking please complete our booking form and return it to us with your non-refundable deposit of 25% of the total booking cost. If you make your booking within 56 days (8 weeks) of your departure date we will require full payment for your booking. We will send you a confirmation of booking along with all the information pertinent to the experience you have booked. Your booking should only be considered definite when you receive this confirmation, at which stage these terms and conditions of booking, your booking form and the information we have supplied, forms your contract with Outdoor Brand Concepts Ltd. Customers placing a booking will be deemed to have agreed to the following three conditions:
- they have read and accepted our booking conditions.
- they appreciate, on behalf of all the people included in their booking, the risks involved in adventure travel.
- they or anyone else on their booking does not suffer (or has ever suffered) from any pre-existing medical condition which may prevent them from actively participating in the activities. Payment for all monies due must be paid to us no later than 56 days before your departure date. If you do not pay by the due date we reserve the right to cancel your booking and retain your deposit. We accept payment by direct transfer of funds into Outdoor Brand Concept's Ltd Client Trust account, by debit or credit card or by cheques drawn by a UK bank.
- Changes by you

We will endeavour to meet any alterations to your booking that you request, however these are subject to availability and cannot be guaranteed. Any requests must be made in writing. Most of our experiences are sold for a set price regardless of how many people participate up to a specified maximum number of people. If participants drop out it is your responsibility to replace them or to continue with less people. If changes you request result in additional charges being levied by the service providers of your chosen experience, you will be responsible for this extra cost.
- Cancellation by you

Should you unfortunately need to cancel you must notify us in writing. In all cases your deposit will be retained. If you cancel within 56 days of your departure date, after paying for the experience in full, Outdoor Brand Concepts Ltd will retain the full fee. However, if we are able to resell the experience we will refund the amount you have paid, less your deposit. We reserve the right to charge reasonable administration charges where no deposit has been paid or where these charges exceed the deposit received. We strongly recommend that customers take out full insurance, which
includes cover, under certain circumstances, against loss of deposit or cancellation charges.
- Alterations by us

We will do our utmost to provide your experience in accordance with what we have confirmed to you, but reserve the right to make unavoidable alterations after confirmation if necessary. We will advise you of any alterations as soon as possible. If it is a major change, which significantly alters the nature of your experience you will have the choice of accepting the change, accepting an alternative experience (if the price is lower, we will refund the difference) or
accepting a full refund of monies paid. Outdoor Brand Concepts Ltd will not cancel any experience for reason of political tension or natural disaster unless specifically recommended to do so by the Foreign Office or unless the circumstances fall within the scope of Force Majeure - see below.
It is a fundamental booking condition that you accept the hazards involved in this sort of trip and you accept that in visiting remote and mountainous regions there is an element of on-tour flexibility. The itinerary stated is indicative only
and not a guarantee that a particular route will be followed. We reserve the right to change the program for reasons of weather, safety, or any other reason or unforeseen circumstance. Your experience guide's word is always final, and you agree to accept his decision, which will generally be made in your own best interest.
- Insurance

Outdoor Brand Concepts Ltd requires all customers to obtain travel insurance against medical and personal accident risks as a condition of booking. This must be for all activities undertaken and include repatriation costs, air ambulance
and helicopter rescue services and cancellation and curtailment. We recommend a policy provided by Campbell Irvine which is suitable for our experiences. Details of this policy are available on request. We can also recommend insurers who specialise in cover for rock and ice climbing. You may of course wish to arrange you own policy in which case it is your responsibility to ensure that the policy provides comparable or greater cover. You should ensure that there are no exclusion clauses limiting protection for the type of activities included in your experience. You must enter the details of your insurance policy on the booking form, failure to provide these details may result in your booking being cancelled.
- Passports, visas, vaccinations and health

All participants, or if under 18, their parents, are personally responsible for ensuring that they have a valid passport, visa and vaccinations as appropriate, and conform to the health regulations required by the destination countries. Outdoor Brand Concepts Ltd is able to provide basic advice to customers regarding passports and visa requirements, however you should check with the appropriate Embassy, Consulate or British Foreign Office for the exact requirements. We are also able to advise on mandatory health requirements, however, we are not medical experts. We advise customers to
seek advice on recommended vaccinations and precautions from a GP, practice nurse, pharmacist or travel health clinic, at least 8 weeks before travelling. Passport and visa fees are not included in Outdoor Brand Concepts Ltd charges.
- Liabilities

We accept responsibility for ensuring that all parts of an experience are supplied as described and that all services shall reach a reasonable standard. These obligations and responsibilities are limited where international conventions in respect of air, sea, road and rail carriers apply. We shall not be liable for any damages caused by total or partial failure to carry our the experience if such failure is: attributable to anyone other than Outdoor Brand Concepts Ltd staff or its service suppliers; unforeseeable or unavoidable and attributed to a third party unconnected to us; a result of unusual or
unforeseeable circumstance, reasonably beyond the control of Outdoor Brand Concepts Ltd; a result of an event which Outdoor Brand Concepts Ltd or any of its service providers, even with all due care, could not foresee. Except in the case of death or personal injury caused by our negligence or our service provider's negligence, our liability for nonperformance or improper performance of our contract with you shall be limited to refunding the full price of the
experience booked. We cannot accept responsibility or pay any compensation for events beyond our control, such as (without limitation) acts of God, war (whether declared or undeclared) terrorist activities, currency fluctuations, strikes, or government restrictions.
- Baggage and personal effects

These remain your responsibility and at your risk at all times. We advise against carrying large amounts of money or items of high value. Money and valuable items should at no time be left unattended. Outdoor Brand Concepts Ltd will incur no responsibility for loss of passports, airline tickets or other documents or for loss of, or damage to, luggage or any other belongings of participants, unless our negligence can be proved.
- Conduct and damage

When you book with Outdoor Brand Concepts Ltd you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid direct at the time to the relevant service provider. We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of our service provider, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we, or the service provider are entitled, without prior notice, to terminate the experience of the person/s concerned. In this situation, the person/s concerned will be required to leave the accommodation or other service. Neither we nor the service provider will have any further responsibility
toward such person/s including any return travel arrangements. No refunds will be made and neither we nor any service provider will pay any expenses or costs incurred as a result of the termination.
- Data protection

We will provide your personal information, as well as personal information you provide in relation to others in your party to our service providers, that might be located outside the UK and/or EU, to enable the operation of the services required by you. If you make special requests, which include, but are not limited to, special dietary, religious, or disability related requirements which constitute sensitive information, the relevant data will also be passed to the relevant service provider to enable provision of the services requested by you. We will apply appropriate security measures to protect this data.
- Website accuracy

All information given in our website and confirmations are, to Outdoor Brand Concepts Ltd knowledge, correct at the time of publication. Before you enter into a contract with us, we reserve the right to make changes to the information provided.
- Financial protection

Outdoor Brand Concepts are a member of the Travel Trust Association (TTA), which means that your funds are 100% financially protected; this is done in two stages-
- We operate a trust account. This is an independent bank account to which an independent third party has been appointed Trustee. Funds are placed into this account for each consumers total financial protection.
- The TTA Travel Protection Plan is a unique fidelity coverage that covers all clients booking with TTA members up to £11,000 per passenger, should your funds not be in the Trust Account for any reason.
- Complaints

If you are in any way dissatisfied with any aspect of your experience, please notify the service provider of your experience as soon as possible, thereby giving us the opportunity to put things right for you immediately. If the matter
cannot be resolved to your satisfaction, please contact Outdoor Brand Concepts Ltd within 21 days of the end of your experience and we shall endeavour to provide a prompt resolution.
- Governing Law

This contract shall be governed by English law and shall be subject to the non-exclusive jurisdiction of the English courts. ExplorAider is a brand marketed by Outdoor Brand Concepts Ltd.
